Can a foreign court judgment be enforced in Thailand?
Not directly. A new case must be filed in Thailand, using the foreign judgment as evidence. Foreign arbitral awards are different: Thailand has been a New York Convention state since 1959, and awards are enforced under the Arbitration Act B.E. 2545 (2002).
How long do I have to claim an unpaid trade invoice?
Often only 2 years for a merchant’s claim for goods delivered or services provided (Civil and Commercial Code s.193/34). Loans and most other contract claims generally run for 10 years (s.193/30).
Can a foreigner inherit a condo in Thailand?
A foreign heir can take a condo unit within the foreign quota. Releasing the unit, or Thai bank accounts, usually requires a Thai court order appointing an administrator, even when there is a will.
Do I need to travel to Thailand?
Usually not. Most matters can be handled remotely by power of attorney, with documents signed where you are and certified or legalised as required, subject to applicable rules and regulations.
