- Who may practise law in Thailand?
- Only Thai nationals licensed by the Lawyers Council of Thailand may practise law and appear in Thai courts (Lawyers Act B.E. 2528).
- Are foreign judgments and awards enforceable?
- Foreign court judgments are not directly enforceable; the case must be brought again in Thailand. Foreign arbitral awards are enforceable under the New York Convention, to which Thailand has been party since 1959.
- Can an insurer recover what it has paid?
- An insurer that has paid a claim steps into the insured’s rights against the at-fault party (Civil and Commercial Code s.880).
- How long is the limit for injury claims?
- Tort claims must be filed within 1 year of the victim knowing of the injury and who is liable, and no later than 10 years after the event (Civil and Commercial Code s.448).
- Do Thai documents carry an apostille?
- No. Thailand is not a party to the Apostille Convention. Documents are legalised by the Ministry of Foreign Affairs’ Department of Consular Affairs and then by the destination country’s embassy.
- How long do creditors have to claim in a Thai bankruptcy?
- 2 months from the published receivership order, with a limited extension possible for creditors abroad. Notices are published in Thai.

Can an insurer recover from a Thai at-fault party?
Yes. An insurer that has paid the claim steps into the insured’s rights against the at-fault party. Act quickly: tort claims must be filed within 1 year of the victim knowing of the injury and who is liable. See also Incidents Abroad.
